Arbitration Law
Arbitration is a type of Alternative Dispute Resolution that results from the interested parties, usually by contract, agreeing to settle their dispute with one or more impartial third parties (known as “arbitrators”), who issue a binding decision to the interested parties. Arbitration is follows less formal rules of evidence and procedure than what is used in a trial court. Arbitration is usually a quicker, cheaper way to resolve disputes than going to trial. However, even though the Arbitrator(s) can issue a binding agreement, a trial court still has limited review of these decisions.
The following are decisions of interest of the Darke County Court of Common Pleas relating to arbitration law:
- Midmark Corporation v. Towe & Associates, Inc.
- United Ohio Insurance Co. v. Central Mutual Insurance Co.
